Privacy Addendum for Personal Information Protection Law (For Mainland Chinese)

This addendum (“Privacy Addendum”) is integral to the “Notice to Customers relating to the Personal Data (Privacy) Ordinance” and/or “Manulife Personal Information Collection Statement” (collectively referred to as “Notice”) and specifically applies to customers located within the borders of the People’s Republic of China.

Unless otherwise specified, the capitalized terms used in this Privacy Addendum but not otherwise defined herein shall have the meanings set out in the Notice, the Personal Information Protection Law (“PIPL”) and other relevant laws and regulations.  In the event of any discrepancies, definitions under the applicable laws and regulations shall prevail.

 

Collection

 

Manulife collects personal information from customers as necessary for the purposes as outlined in the Notice and this Privacy Addendum. From time to time, it may also be necessary for Manulife to collect personal information while customers are within the territory of the People’s Republic of China (excluding Hong Kong, Macao and Taiwan for the purpose of this Privacy Addendum) (“PRC”). For doing so, Manulife is required, and acknowledges the importance, to obtain the customers’ explicit and voluntary consent to collect and process personal information, including sensitive personal information, and for sharing with third parties. For sensitive personal information as defined under the PIPL, a separate consent may be required from customers.

While Manulife generally do not directly collect personal information from minors under fourteen (14) years of age, such information may be obtained from the parent or legal guardian when necessary to provide relevant products and/or services. The minor’s individual rights, as outlined in this Privacy Addendum, may be exercised by the parent or legal guardian on behalf of the minor.

Unless otherwise specified by the law, failure to provide the required consent may render Manulife unable to provide, or continue to provide, the relevant products and services.

 

Purposes

 

In accordance with the Notice and PIPL, Manulife collects customers’ personal information and such personal information may be used for the purposes stated in the Notice depending on the nature of the customer’s relationship with Manulife. Manulife ensures that personal information is processed based on customers’ consent, unless the personal information is processed due to the following specific circumstances:

• To conclude or perform a contract where the customer is involved;
• To fulfil with legal obligations;
• Respond to public health emergencies;
• Protect individuals’ lives, health and property safety under emergencies;
• Facilitate news reporting and public opinion oversight for public interests;
• When the information is publicly available due to the customers’ voluntary disclosure or a legal requirement; and/or
• Other circumstances stipulated by laws and regulations.

 

Transferees

 

Manulife may share customers’ personal information with third parties, affiliate companies, or other transferees (“Data Recipients”) for the purposes stated under the Notice and this Privacy Addendum.

Customers’ personal information may also be collected, assessed, processed, used, stored, and/or transferred to Data Recipients inside or outside the PRC to the extent necessary and lawful. There may also be cases where Manulife needs to transfer customers’ personal information due to corporate actions, including mergers and acquisitions. In these cases, customers will be notified separately, and updates will be posted on Manulife’s website. Customers can refer to the list of Data Recipients for detailed information. This list is periodically updated to ensure accuracy and compliance with relevant law and regulations.

 

Data Retention

 

Manulife retains customers’ personal information for the duration necessary to fulfil the purposes set out under the Notice and this Privacy Addendum and for compliance with law and regulations.

Unless Manulife is required to retain certain personal data in view of legal and regulatory obligations, customers’ personal information is securely disposed of after the retention period.

 

Data Security

 

Manulife is committed to deploy necessary measures to safeguard the security of customers’ personal information. This includes the implementation of technical, and administrative controls to ensure the confidentiality, privacy, and integrity of the data. These measures are regularly updated to align with applicable laws, regulations, and industry best practices.

When Manulife entrusts other entities to handle customers’ personal information, Manulife will ensure the entrusted parties adopt the same or similar standards to safeguard the security and confidentiality of the personal information.

 

Individual rights

 

Manulife strives to ensure customers’ information is accurate and complete. In addition to the rights outlined in the Notice, subject to the laws and regulations, customers have the right under the PIPL to:

1. Access or receive a copy of the personal information;
2. Rectify or supplement personal information deemed inaccurate or incomplete;
3. Erase or restrict to the processing of personal information by others; and
4. Rescind consent for the use of personal information.

Any requests to Manulife to cease processing of personal information will not affect any processing that has already taken place at that time. Customers can contact Manulife to withdraw consent regarding the processing of personal information using the provided contact information in this Privacy Addendum. However, it is important to note that withdrawing consent may impact Manulife’s ability to provide relevant products and services to customers.

 

Updates and Changes

 

The Notice and Privacy Addendum may be updated periodically.  Manulife will make all reasonable efforts to notify any changes that may affect the processing of customers’ personal information.  These updates will be posted on the Manulife website.  Customers are encouraged to routinely review the Manulife website for privacy updates.
